Coping With Cops.

Young Rita Waln led a procession of women and children who shook hands with officers at the ND Capitol after they held a demonstration to deny charges that weapons or pipe bombs were at the Lakota encampments along the Missouri River. About 200 water protectors took their message of peace to the governor that they are unarmed and peaceful.

Young Rita Waln led a procession of women and children who shook hands with officers at the ND Capitol.

Throughout the peaceful protest that water protectors are waging against the Dakota Access pipeline near the Standing Rock Sioux Indian Reservation, rumors have swirled about potential threats to public safety—rumors that have been refuted by numerous images and accounts of what is actually happening.

It started with claims on August 17 by Morton County Sheriff Kyle Kirchmeier that those standing against the pipeline were compromising safety and continued this past weekend, when North Dakota Governor Jack Dalrymple went so far as to declare a state of emergency across several counties in order to free up federal funds.

“They were preparing to throw pipe bombs at our line, M80s, fireworks, things of that nature, to disrupt us,” Kirchmeier told reporters. “And that in itself makes it an unlawful protest.”

Though Dalrymple stopped short of activating the National Guard, he issued an executive order implying that public safety was at risk.

With a gathering that has swelled to more than 3,000 people and counting, friction and conflict might not be out of the realm of possibility. But the opposite is in fact the case: accounts and pictures abound of police officers taking off their hats in respect for the daily morning prayers being conducted at the construction site; police shaking hands with a little girl; officers being smudged.

Here are six images of how the dynamics are really playing out on the ground, including one issued by the Bismarck Police Department itself.

HUNKPAPA TERRITORY—John Eagle Shield Sr. of Standing Rock, one of several traditionally appointed camp leaders, estimated on Sunday August 21 that about 2,500 people were peacefully gathered amongst what has grown into three separate prayer camps. The mission of those gathered is to protect Standing Rock’s water from the environmentally disastrous Dakota Access Pipeline. The campsites are clustered on the west side of the Cannonball River just north of Cannon Ball, North Dakota, along the Standing Rock reservation’s northern border, where the pipeline is slated to cross.

Jacobin has a good article up:

The federal response to Lakota protests against the Dakota Access Pipeline couldn’t be more different than their reaction to this year’s Bundy occupation.

[…]

The Lakota, on other hand, are resisting a real and all too familiar danger. Their numbers grow every day. And, unlike the standoff in Oregon, almost no major national news outlets are covering the story. This too participates in a great American tradition: the true fight against oppression is the one nobody notices.

Is that ever the truth. Mainstream media is doing their damndest to ignore us, to ignore the issue. Thanks to Michael McLean at Jacobin for a very good story. Go read, please!

There continue to be problems, like this:

People at Pine Ridge rez are being harassed by cops, and turned back in their attempts to travel to the camps. This has been going on a while. The concrete roadblocks remain in place here in ND, and the state is bristling with armed cops. The camps continue to grow, as more people from all roads join us, there are 3 camps now, Sacred Stone Camp, Oceti Sakowin (Seven Councils) Camp, and Red Warrior Camp. There are ways into the camps, keep coming, people, join us! The usual caveat: no feds, no guns, no alcohol. We need supplies, donations, signatures, signal boosting! Yell, talk, dance, light the cedar and sage, please, please stand up, stand with us, join us.

Cop Union: Accountability? Uh uh, Give Us Money.

City leaders in San Antonio will soon vote on a new union contract for police officers that contains no reforms to accountability processes for cops, because the officers’ union wanted more money before agreeing to higher standards.

Mayor Ivy Taylor brought a seven-point list of reforms to union negotiators this spring, the San Antonio Express-News reports, but none made it into the contract. If the City Council ratifies the deal on September 1, the city will continue to face tight limits on how it can discipline officers.

Any misconduct records older than two years cannot be used to justify punishment for new incidents. Short suspensions that officers do not appeal get erased and converted into simple reprimands on their records after two years.

Taylor’s seven-point wishlist would have ended each of those rules, giving the Chief of Police greater ability to punish repeat offenders and examine patterns of behavior across an officer’s full career when deciding to suspend, demote, or fire a cop.

“The (police) chief (William McManus) and I feel that it is important, but the union was not willing to consider that and they wanted to be paid for any changes in the disciplinary process,” city manager Sheryl Sculley told the Express-News.

The contract already includes a 14 percent raise over four years. The raises union officials reportedly sought in exchange for reform would have been over and above those pay bumps — something that one activist called “essentially extortion.”

Dakota Access Standoff Calls on Obama.

Standing Rock Sioux Chairman David Archambault II continued calling for peace and nonviolence as demonstrations continued at a construction site for the Dakota Access oil pipeline, a day after a federal district court in North Dakota granted a temporary restraining order against those it deemed were interfering with the work.

“As we have said from the beginning, demonstrations regarding the Dakota Access pipeline must be peaceful,” Archambault said in a statement to reporters on August 17. “There is no place for threats, violence or criminal activity. That is simply not our way. So, the Tribe will do all it can to see that participants comply with the law and maintain the peace. That was our position before the injunction, and that is our position now.”

Archambault also alluded to President Barack Obama’s 2014 visit to the Standing Rock Sioux Reservation, and his offer of help, noting that back then he did not ask the President for anything.

“I just showed him the reality of our lives,” Archambault said. “I believe both he and Michelle Obama were touched. So now if there’s any way he can intervene and move this pipeline off our treaty lands, I’m asking him.”

The temporary restraining order, dated August 16, prohibits the named defendants “and unidentified individuals,” designated as John and Jane Does, “from interfering with its right to construct the Dakota Access Pipeline (the “Pipeline”) in accordance with all local, state, and federal approvals it has obtained,” read Dakota Access LLC’s request to the court. Construction was halted due to “safety concerns,” the company said.

People vowing to protect the waters of the Missouri have gathered on land along the river owned by Standing Rock tribal member LaDonna Allard. The Sacred Stone Spiritual Camp, as it is called, has been occupied since April. It swelled from a few dozen a week ago to more than 2,500 by August 17, according to an estimate by tribal officials.

The court sided with Dakota Access LLC and granted the restraining order on the grounds that the permits were valid and thus give the company the right to start construction on the portion that will cross Lake Oahe, which was formed by the Oahe Dam on the Missouri River.

“Dakota Access has obtained the necessary easements and rights of way to construct the Pipeline in North Dakota and the necessary federal, state, and local permits for the Oahe Crossing,” the court said in its motion. “In accordance with the permits and approvals obtained for the Pipeline project, Dakota Access has commenced construction activities in North Dakota.”

[…]

The $3.8 billion, 1,172-mile-long pipeline would cross the Missouri River itself, in addition to the lake. Standing Rock Sioux Tribe officials say that in crossing Lake Oahe and the Missouri River, the pipeline would disturb burial grounds and sacred sites on ancestral Treaty lands. Archambault said that over the past several days he had met and spoken with everyone from demonstrators, to tribal government and spiritual leaders, to state and local law enforcement officials.

“In all of these meetings, my message has been consistent—we need to work together in peace,” he said. “And, as I continue to spread this message, I believe that the word is getting out. Standing Rock wants there to be peace.”

The chairman said he has also met over the past year with federal officials from numerous agencies “to express the Tribe’s strong opposition and to let them know that we will be heard,” and noted the upcoming hearing on the tribe’s lawsuit against the Army Corps.

“Our basic position is that the Corps of Engineers has failed to follow the law and has failed to consider the impacts of the pipeline on the Standing Rock Sioux Tribe,” he said.

Also pending is a lawsuit filed by Dakota Access LLC against Archambault and several others simultaneously with the motion for a restraining order. The suit was filed after Archambault and about a dozen others were arrested during the demonstrations on August 11. Construction began on August 10.

Numerous tribes have expressed support for the Standing Rock Sioux, responding to a request for “proclamations, resolutions and/or letters of support,” the tribe said in an August 15 statement. All the tribe wants, Archambault said, is that the pipeline not be built across Treaty lands.

Baltimore: Lawyers, Cops, and Nazis. UPDATED.

A 2002 rally by neo-Nazi group the National Alliance (Flickr Creative Commons).

A lawyer hired by the city of Baltimore to defend police officers in court has long-standing connections to a neo-Nazi group, but insists that his “crazy ideas” do not affect his work.

The New York Daily News reported Thursday that attorney Glen Keith Allen is a longtime supporter of the National Alliance, a group the Southern Poverty Law Center calls “explicitly genocidal” and which is characterized as a hate group.

Allen admits he joined the National Alliance because, “I was in the U.S. Army from 1978 to 1982 and I had some pretty awful experiences with black people there, to be honest.”

While he is not currently involved in the Freddie Gray case, Allen has defended the Baltimore Police Department in court, notably in a current lawsuit brought by Sabein Burgess, a black man says he was wrongfully convicted and spent 19 years in prison before being released in 2014.

[…]

In spite of Allen’s insistence that he left the National Alliance in the 1980s, he was still paying membership dues in 2003. The 65-year-old attorney also attended a Holocaust-denial conference in 2007, but denies that his views affect his work for the city in any way.

“I have an unblemished record in 30 years of practicing law…I have the highest ethical standards and zealous representation of my client, and that’s what I’ve been doing for the city,” he told the Daily News.

The Anti-Defamation League said that the National Alliance “dehumanize(s) both blacks and Jews, depicting them as threats to ‘Aryan culture’ and ‘racial purity.’”

Federal Election Commission (FEC) documents show that Allen is a donating member of the American Eagle Party, a fringe right group led by a man named Merlin Miller who says that Israel planned the 9/11 attacks in cahoots with the U.S. government.

“Should I be fired from the city of Baltimore because I have crazy ideas about 9/11?” Allen said.

I think you should be relieved of your position because you’re a nazi, Mr. Allen. Apparently, this doesn’t bother the city of Baltimore or cops in the least. It would certainly bother me, but I guess cops are tossing away any pretense of a standard these days.

UPDATE: Mr. Allen has been relieved of his position with the city. You can read about it here.

There is the woman being publicly strip-searched after being stopped for a missing headlight. There are the officers coercing sex from prostitutes in exchange for avoiding arrest, planting drugs on people they stopped, cursing “shut the fuck up bitch” because they are “the fucking law.” There is the supervisor telling officers “to arrest ‘all the black hoodies’ in a neighborhood.” There are officers using templates for arrests where they only had to fill in dates and names — the words “black male” were already inked in.

Running to 163 pages, the Department of Justice report on the ongoing abuse inflicted upon African Americans by the Baltimore police is full of stories like these.

In light of the DOJ report on just how corrupt the Baltimore cops shops are, of course the staunch defenders of bigoted, killer cops, the FOP, decided to have their conference, which was protested. Well, for a while, at least, until all those pesky persons insistent on pointing to reality were arrested.

Baltimore police arrested a dozen protesters at the Hyatt Regency on Sunday afternoon where the state Fraternal Order of Police was holding a conference.

Some of the protesters refused to leave the hotel on Light Street, blocked access to an escalator and chained themselves to railings as part of a demonstration against discriminatory police practices.

The group, some of whom were with the activist group Baltimore BLOC, were joining hands and carrying signs that read “Abolish Racist F.O.P.”

Arizona Cop Terrifies Tourists.

Artist Ken Walton ad daughter Wren — Facebook.

In a post going viral on Facebook, Ken Walton describes being arrested at gunpoint by an Arizona Highway Patrol officer who threatened to shoot him in the back in front of his 7-year-old daughter.

Here’s what Ken says happened:

My daughter and I are from San Francisco, on vacation, traveling through the Southwest. Today we were driving from Hoover Dam to the Grand Canyon in a Toyota Camry we’d rented from Fox Car Rental in Las Vegas. In Williams, Arizona, as I exited Interstate 40 to head north toward the Canyon rim, I was pulled over by an AHP officer who’d been tailing me for a couple of miles. I hadn’t been speeding, so I wondered if perhaps the car had a broken taillight or something. I rolled down my window and waited.

Suddenly, the officer rapped on the rear passenger side window with his pistol. My daughter, who was sitting inches from the barrel of his gun, jumped with fear as the officer yelled at me to roll down the front passenger window, his service weapon pointed directly at me. I knew something was terribly awry and I tried to remain calm, keeping my hands visible as I slowly fumbled for the window controls in an unfamiliar car. My daughter rolled down her window and I explained that we were in a rental car, that we had no weapons, and I was having trouble figuring out how to roll down the front passenger window from my driver’s side door. The officer didn’t listen, and kept yelling louder and more insistently, ordering me to comply with his request as he leered at me down the barrel of his pistol. My daughter panicked and tried to get out of her booster seat to reach forward to roll down the front window, and the officer screamed at her not to move as he pointed his pistol at her.

John Lott: Oh So Fraudulent.

JOhn_Lott_screencap-800x430

Think Progress has an excellent, in depth look at the fall and rise of John Lott, the so-called academic of the NRA and gun fondlers everywhere. Apparently, his fraudulent, unethical past has not stopped people from taking this scary side quack seriously, once again.

The United States seems to be in a perpetual cycle mourning mass shootings in the country. This year alone, there have already been 233 mass shootings, where four or more victims were shot, leaving 310 dead and 930 injured. But every time another shooting happens, advocates pop up arguing that more guns don’t actually lead to more violence and stall the much-needed conversation about gun control.

John Lott is, if not the most influential, certainly the most prolific “academic” in the gun debate. He has authored weekly columns in local newspapers on the horrors of gun free zones, published widely-distributed books on the ostensible benefits of right-to-carry laws, and his newest book The War on Guns has received rave reviews by prominent conservatives, like Sen. Ted Cruz (R-TX), Sen. Marco Rubio (R-FL), and Newt Gingrich.

Before Lott’s flurry of activity, it was difficult to find anybody arguing that widespread gun ownership made societies safer — even the NRA was reticent to make such a bold claim, defending gun ownership with reference to the constitution, not criminology.

But Lott’s recent successes belie a far more shadowy past. A little over a decade ago, he was disgraced and his career was in tatters. Not only was Lott’s assertion that more guns leads to more safety formally repudiated by a National Research Council panel, but he had also been caught pushing studies with severe statistical errors on numerous occasions. An investigation uncovered that he had almost certainly fabricated an entire survey on defensive gun use. And a blogger revealed that Mary Rosh, an online commentator claiming to be a former student of Lott’s who would frequently post about how amazing he was, was in fact John Lott himself. He was all but excommunicated from academia.

Despite his ethical failings, Lott rose from the ashes in the wake of the 2012 mass shooting at Sandy Hook Elementary School to once more become a prominent voice in the gun debate.

Perhaps unaware of Lott’s previous transgressions, or believing he had turned a new page by founding the Crime Prevention Research Center (CPRC), many in the media who were desperate for an authoritative, pro-gun academic voice seized on Lott’s credentials and provided him with a new platform. In the past few years, Lott and his organization have been cited by dozens of media outlets as an authority on gun violence statistics, including the Washington Post, the Wall Street Journal, LA Times, Politifact, CBS, CNN, Fox News, and many others.

However, the media’s newfound faith in John Lott is deeply misguided. Rather than turn a new page, Lott has instead returned to his old playbook and used his platform to deceive the public. Our own multi-year investigation into Lott and his organization has uncovered a startling array of new ethical violations, ranging from the profoundly bizarre to the outright fraudulent.

Devin Hughes and Evan DeFilippis have a breakdown of the five most troubling incidents at Think Progress. Highly recommended reading, because way too many people believe this absolute bullshit, clinging to it, because this confirms what they so desperately want to believe, that the good cowboy with the gun can come blazing in to save the day against any odds, no matter how overwhelming. In a country so stuffed with guns, it doesn’t do to simply dismiss the high amount of fantasists with guns, they are dangerous, and becoming more dangerous every day, and it’s well to remember that many of those gun happy fantasists are cops, who play their little fantasies out every day. It pays to be well informed, especially when it comes to a con-man happily shilling for the NRA, and assuring all those fantasists they are so very right.

Cop Who Killed 73 year old: record of excessive force.

Punta Gorda Police Officer Lee Coel is pictured in this undated handout photo, received August 11, 2016. Punta Gorda Police Department/Handout via Reuters.

Punta Gorda Police Officer Lee Coel is pictured in this undated handout photo, received August 11, 2016. Punta Gorda Police Department/Handout via Reuters.

A Florida police officer who mistakenly killed a 73-year-old woman during a role-play exercise this week has been the subject of excessive force complaints in the past, according to a police official and media reports.

[…]

Punta Gorda police have released few details about what led to Knowlton being shot by a live round, and Lewis declined to answer questions at the news conference.

He acknowledged reports that Coel, a K-9 police officer, had been accused of allowing his police dog to attack a man while on patrol in October last year.

“This officer was involved in a K-9 apprehension incident,” Lewis said. “Currently that incident is in civil litigation.”

Lawyer Scott Weinberg said Coel intended to cite his client, Richard Shumacher, for riding a bike at night without a headlight or taillight when the attack occurred.

Weinberg, who has filed a notice of intent to sue the city and the police department, released a police dash-cam video of the incident earlier this year. In it, Coel can be seen holding Shumacher down while the dog mauled him.

“The bottom line is that when I released this video two months ago, I had warned everybody that this man was going to kill somebody,” Weinberg said in a phone interview. “I told the chief to his face that this man was dangerous.”

Coel also was accused of excessive force in April 2013 while working as a police officer for Miramar, Florida police, court records show.

That incident and another case led investigators to determined Coel had violated department policies, and he was forced to resign, the Miami Herald reported.

Is anyone surprised by this? Anyone? Why, every single time, does it take multiple incidents, and at least one death to kick an evil asshole out of a cop shop? And lately, even murdering people isn’t enough to get cops fired. This is so wrong. Beyond wrong. Beyond fractally wrong. This has to stop. A cop gets investigated for excessive force? That’s it, you’re out, and you lose everything, job, pension, all of it. Maybe, just maybe, cops might start getting the message that a badge is not a license to do whatever they want.

Darnell Wicker.

Darnell Wicker (Photo: Family of Darnell Wicker).

Darnell Wicker (Photo: Family of Darnell Wicker).

Darnell Wicker was pronounced dead around 2 a.m. from multiple shots to his torso, upper right extremity and lower extremities after police officers opened fire on him. The Jefferson County Coroner’s office in Louisville, KY admitted that they don’t know exactly how many times the 57-year-old man was shot.

Police officers Taylor Banks and Beau Gadegaard were responding to a domestic violence call when Wicker came outside holding a knife and a tree saw, according to WDRB.

“He came outside — he came out the door and was holding a knife in his hand, he started kind of swinging it around a little bit and he kind of came at us and so we shot,” an officer explains on the video.

Two women who witnessed the event tell a different story, however. Anita Jones, Wicker’s girlfriend and Denita Jones blame the police.

“They just ran up past him — around him — and just said, ‘Drop your weapon!’ Pow! Pow! Pow! Pow!” Anita Jones described police not waiting for Wicker to drop the items. “He had no chance to drop the weapon.”

“The officers jumped out, came around, pushed her out of the way,” said Denita Jones. “I was far enough over here that he ran beside me, pushed her out of the way, said, ‘Ma’am move!’ ran up, the other one went that way. ‘Put it down!’ Pop! Pop! Pop!”

The officers also didn’t perform any kind of first aid on Wicker and the EMTs arrived nine minutes after he was shot.

“I was the person who actually had called them, and I didn’t want that to actually happen,” Denita Jones said. “That was my thing. I just wanted the situation to be okay.”

Once again, you have cops shooting someone, and once again, you have cops who refuse to render aid, even the simple act of calling for an ambulance. This has happened time and time again. Michael Brown. Paul O’Neal. And so many more. Pretty much all the people shot by cops. This is a demonstration of ingrained callousness, the dehumanization of bigotry. Body cam footage is below the fold, and it is graphic, so all the warnings.
