The Fuzziness of the Army Corps.

As with most issues between Indian country and the federal government, the important bits are steeped in legalese and long numerical references to laws and regulations. The very stuff of life and its protection, however, is referenced and hidden within these dryly-worded documents.

A set of regulations created by the U.S. Army Corps of Engineers (USACE) called Appendix C is one such example, and it may determine the future of the Dakota Access Pipeline project as well as other projects for which the Army Corps is responsible for issuing federal permits.

It turns out that tribes have been complaining about the legality of Appendix C for a very long time, and with good reason. Appendix C spells out how the Corps will meet its obligation to fulfill Section 106 of the National Historic Preservation Act (NHPA), created to protect places of historic, architectural and/or cultural significance.

Part of the NPHA’s Section 106 requires that agencies carry out the process in consultation with Tribal Historic Preservation Officers (THPO) and identify and assess impacts to properties of traditional religious and cultural significance to tribes. Although all federal agencies are allowed to create their own means by which they fulfill the requirements of Section 106, the Army Corps chose to streamline the process by creating its own regulations that tribes and other federal agencies argue not only fail to meet the requirement of the NHPA’s Section 106, but are also in direct conflict with the law.

The Advisory Council on Historic Preservation (ACHP) is an independent federal agency charged by Congress with overseeing implementation of the NHPA. The Corps contradicts several of ACHP’s regulations through use of its own process spelled out under Appendix C.

The differences between Section 106 regulations and Appendix C are substantial. Chief among these differences includes the Corps’ decision in the Standing Rock case to review each river crossing of the Dakota Access pipeline as a separate project rather than consider the entire pipeline as one project.

“This allows the Corps to dismiss the potential for effects to historic properties that may be located within the broader project area of an undertaking,” according to an August 2, 2016 letter from the ACHP to the Corps.

California: No Porn for You!

Some porn providers have decided to get political, and fight California’s Proposition 60. While I do think health is a major concern, I really don’t know enough about the porn industry in general to make any sort of statement about their particular health policies in regard to their actors. I would assume most actors do care about their health, and don’t take unnecessary risks, but again, I really don’t know. I might be one of ten people on the planet who is not a porn consumer. I certainly do understand the fight against part of the prop which states they can be sued, by anyone, at anytime. That seems more than a little dodgy to me. I’m also very uncomfortable when it comes to anyone trying to mandate another person’s bodily autonomy. I don’t want anyone telling me what I can and can’t do with myself, as I am my body. That should apply to everyone else as well.  So, if I were still in SoCal, I’d be a no vote. Anyroad, as a political tactic, I foresee great success here.

Today, adult websites are taking away California’s porn. In protest of Proposition 60, a state bill mandating condoms in adult films, several sites are interrupting or entirely blocking access to California IP addresses. This includes the mainstream giant Vivid Video, as well as Evil Angel, Kink, Pink & White Productions, and Treasure Island Media. In-state visitors to these sites are met with a message instructing them to vote no on Prop 60 and, in some cases, warning that their porn might be permanently taken away if the bill passes.

This virtual strike coincides with a protest by roughly 100 adult performers planned later today outside of the Los Angeles headquarters of the Yes on 60 Campaign.

Prop 60, which is sponsored by AIDS Healthcare Foundation and will be on the ballot November 8, requires condoms in adult films shot within the state and also allows any resident in the state to sue producers and distributors of condomless porn. The adult industry is broadly opposed to the bill, primarily on the grounds that it violates performer choice and will push productions underground, making them less safe. Opponents also argue that by allowing lawsuits by everyday citizens the bill could expose producers and adult performers to stalkers, harassment, and privacy violations.

But at least three studios are considering the possibility of permanently blocking access to Californians if the bill passes — the thinking being that if Californians can’t see their content, maybe they can’t file lawsuits. Vivid’s website greets in-state visitors with a black screen bearing a “NO ON 60” icon and a message reading, “If you live in California and Prop 60 passes this is what your porn will look like.” Pink & White Productions’ pay sites greet all visitors with a pop-up reading, “IP BLOCK California? SAY IT AINT SO! If California Prop 60 passes, it could be” (although it’s possible to close it and navigate the sites). Kink’s site delivers a message reading, “This is what Californa will see on their favorite porn sites if PROPOSITION 60 passes.”

Mike Stabile, Kink’s spokesperson, told Vocativ, “Prop 60 isn’t a public health measure, it’s a public harassment measure for adult performers. If we have to block access to California in order to protect the performers who work with us, that’s what we’ll do. And should this initiative pass, it’s something we’ll be looking at doing in California on a permanent basis after November 8.”

George Takei has an open letter at The Daily Beast, and a message many of us sorely need to hear. Just an excerpt from the middle here:

You see, I am ever an optimist. A poll taken in August of voters aged 18-34 showed that the vast majority favored Clinton over Trump—64 percent to 29 percent. That split tells me the same thing that the polls for same-sex marriage told us years ago: Over time, reason and fairness will win out, while bigotry and hatred literally would die off. In 20 years, you will all be in charge, and demonstrate far less appetite or patience for Trump’s brand of nativist rhetoric and race baiting. Trump and his supporters understand they are on borrowed time, and while they may seem resurgent today, this in fact could be their last chance to take control. Our country is rapidly moving on from their discredited and archaic worldview. Perhaps that is why the death throes of their campaign are so spectacular.

You are in many ways wiser to the world than your older counterparts. You came of age in a time where there was greater cause for skepticism, and you’re accustomed to the non-stop barrage of social media. Unlike your parents, you understand that we all live in an echo chamber, and that it is up to each of us to depart from it to hear alternative points of view. You are more likely to place your trust in science and embrace diversity, to reject hate while celebrating love in all its manifestations. You are more focused on racial justice and equality of opportunity than the two generations before you. And contrary to common myth, you are not disengaged. In this election cycle, millions of young voters made their concerns heard and very nearly succeeded in realigning the entire election. Nor are you impractical; even when your favored candidate did not succeed, you stuck by your convictions and goals, and in overwhelming numbers now support the party that will best advance them.

Most people will have a passing awareness of what’s been happening to refugees attempting to reach Australia. To say the Australian government has a lot to answer for is one hell of an understatement. This is open, unapologetic torture, and right now, it doesn’t look like anyone much cares that the main effect of this “open air camp” is suicide. When death becomes a preferable option, you get an idea of just how bad things are. These people, already carrying heavy burdens of trauma, are being treated as untouchable, nasty things, and as Esme Weatherwax pointed out, all the ills in the world begin there, with treating people like things. Although reading, it seems to me they are more being treated like inconvenient garbage that someone littered about. This is a terribly ugly story, filled with terribly ugly people, who cannot manage to dredge up the smallest sliver of concern. All around the world, we human beings are failing at being human, in a most spectacular way.

Refugees and asylum seekers who attempt to reach Australia by boat are turned away and detained in refugee processing centers on the Pacific island of Nauru or Manus Island in Papua New Guinea. The Australian government has argued that the policy acts as a good deterrence against human smugglers and people who might choose to undertake the journey to its shores. But those who wind up on these offshore detention sites face indefinite and unlawful detention, an ordeal so disastrous that refugees and asylum seekers are turning to self-harm to cope, according to a new human rights organization report released Monday.

The Amnesty International report found that it was not uncommon for detainees to try and kill themselves, based on field and desk research that happened between July and October 2016. One man failed to kill himself twice in a span of ten weeks. Another Iranian refugee who tried to kill herself multiple times every week was eventually put in a medical ward. And a man found his pregnant wife in the bathroom with rope marks on her neck.

Some service-providers at the detention center described practices that made refugees and asylum seekers feel less than human. One guard forcibly took away candy from a girl. Some asylum seekers were taken from showers after two minutes, with shampoo in their hair. Others had to wait weeks or months for basic necessities like underwear and shoes.

In a conversation with a seven-year-old boy from Iran, a service-provider told Amnesty International that the child would keep asking him questions. “He’d say ‘I don’t understand this place. Prisons are for bad people, right? Bad people are the men who hurt my father [in Iran]. Why am I in prison? Does that mean I am a bad person?’”

Nauru’s refugee processing center is described as an “open” center meaning that once people are recognized as refugees, they are moved into accommodation outside the refugee processing center on the same island, roughly one-third the size of Manhattan. But much of the island is uninhabitable, now environmentally ravaged by generations of phosphate mining.

Even refugees and asylees living outside detention grounds face Nauru police who fail to adequately investigate their complaints. One father, who told the police about a man who tried to rape his daughter, was told that the judge was “off duty.” An Iranian refugee who tried to report a robbery got the run-around from police who said that “their computer was broken.” When he offered to give handwritten testimony, he was told that they didn’t have paper.

Many of the abuses that Neistat found are consistent with previous accounts of abuse detailed by other refugees and asylum seekers. In late April, at least two refugees tried setting themselves on fire. One died from the self-immolation, while the other refugee suffered critical injuries. In August, The Guardian reported on 2,000 reports of abuse and neglect, which found that children were “vastly overrepresented in the reports.”

People set themselves on fire. On fire, for fuck’s sake. If this does not break your heart, if this does not make you ask questions, if this does not make you angry, something is very, very wrong.

The Australian government spends $419,425 per person, per year on offshore processing. In comparison, the U.S. government spends about $59,860 per person, per year on detention. Yet as the allegations show, the costs do not reflect the care that refugees and asylum seekers receive.

After clicking all the links, and doing all the reading, I would really like to know just where in the hell all that money is going, because it most certainly is not going into care of and for refugees and asylum seekers. The stench of corruption is wafting about.

* I probably have nothing to worry about here, but if  you’re the type of asshole who thinks it would be pertinent to comment about how your two year old could draw better than that 16 year old, you’ll be banned so fast you’ll end up with whiplash.

Pine Nuts.

There’s a very good article at ICTMN about the Western Shoshone tribes and a staple of their diet, pine nuts. A staple, which is considered sacred, and is healthy, it also treated with utter disregard by non-natives, who have been using any excuse to destroy the trees.

“Everything depends on the water and the trees,” said spiritual leader Johnny Bob, from the Yomba Shoshone Tribe, as he prayed for the start of a Western Shoshone pine-nut gathering. In September, members of several bands came together in a steep-walled mountain valley in central Nevada to collect the protein- and nutrient-rich nuts that were once the mainstay of their diet.

Some people took hold of long sticks and began to knock the sticky green cones off the tops of the pinyon trees. Others gathered fallen branches to chop up for the fire in which they would later roast the cones to release the sweet, creamy nuts. These can be eaten out of hand, added to soups and stews or parched and ground for gravy or mush.

“As we collect, we are pruning the trees to ensure there are even more cones next year. We are also cleaning the forest,” explained Joseph Holley, former chairman and now council member of the Battle Mountain Band of Te-Moak Western Shoshone.

This critical food source, along with game living in the forest, began to disappear during the late 19th century, as newly arrived settlers chopped down trees for fuel over many square miles around towns and mining operations. Starting in the 20th century, these losses were amplified by the Bureau of Land Management and U.S. Forest Service, which together have uprooted more than 3 million acres of pinyon-plus-juniper woodlands.

To destroy the forests, the federal agencies use tractors to drag gargantuan chains through them, ripping up everything in their path. The ruined landscapes look like the aftermath of a nuclear holocaust. Sometimes, the agencies eliminate woodlands in order to increase rangeland for grazing, an activity that further damages the fragile arid lands where pinyons flourish. Scientists estimate that soil in an erosion-prone “chained” landscape may take 10,000 years to recover.

I just found out that my neurologist of close to 20 years has died. Dr. Arazi had planned on retiring in December, so I saw him for the last time in May. He was a man of gentle humour, and quiet pride in his family. We always used to get wonderfully distracted, discussing books or other interesting things. He was an altogether lovely man, and a very caring physician. My thanks, for all your care over the years.

In an impressive fossil fuels travel day, I left the Standing Rock reservation and flew to Italy for the International Slow Food gathering known as Terra Madre. A world congress of harvesters, farmers, chefs and political leaders, this is basically the World Food Olympics. This is my fifth trip to Italy for Slow Food. I first went with Margaret Smith, when the White Earth Land Recovery Project won the Slow Food Award for Biodiversity in 2003, for our work to protect wild rice from genetic engineering. This year, I went as a part of the Turtle Island Slow Food Association- the first Indigenous Slow Food members in the world, a delegation over 30 representing Indigenous people from North American and the Pacific. We have some remarkable leaders, they are young and committed.

It is a moment in history for food, as we watch the largest corporate merger in history- Bayer Chemical’s purchase of Monsanto for $66 billion; with “crop protection chemicals” that kill weeds, bugs and fungus, seeds, and (likely to be banned in Europe) glyphosate, aka Roundup. Sometimes I just have to ask: ‘Just how big do you all need to be, to be happy?’

A loud group of about 50 mostly Native protesters disrupted the Entrada kickoff event of the Fiestas de Santa Fe. This is the annual reenactment of Don Diego de Vargas’s “peaceful reconquest” of Santa Fe in 1692 as produced by Caballeros de Vargas, a group which is a member of the Fiesta Council, and several current and past City of Santa Fe Councilors are members of the Fiesta Council or played parts in the Entrada over the years. So these are layers you must wade through when people ask questions and protesters demand changes. And changes or outright abolishment of The Entrada are what the groups “The Red Nation” and “In The Spirit of Popay” are asking for.

The social and economic impacts of climate change have already begun to take their toll—but most people do not yet know this.

Politicians and economists have yet to work out how and when it would be best to adapt to change. And biologists say they cannot even begin to measure climate change’s effect on biodiversity because there is not enough information.

Two studies in Science journal address the future. The first points out that historical temperature increases depress maize crop yields in the U.S. by 48 percent and have already driven up the rates of civil conflict in sub-Saharan Africa by 11 percent.

Rick Bartow, a member of the Mad River Band of Wiyot, walked on April 2, 2016, and had suffered two strokes before he passed. The IAIA Museum of Contemporary Native Arts reports that those events affected his work, and it can be seen in his collection as “exciting examples of Bartow’s production since his stroke… that evidence a new freedom of scale and expression.”

Born in Oregon in 1946, Bartow was never formally trained in the arts, though his artistic nature was encouraged and he did graduate from Western Oregon University with a degree in secondary arts education in 1969. Right after that he served in Vietnam from 1969-1971, and it was demons from that war that he spent his early years in art exorcising. He says he was “twisted” after Vietnam and his art can be described as disturbing, surreal, intense, and visionary; even transformative.

On a recent Autumn Saturday in the Black Hills, a handful of men and women gathered at around 9 a.m. at the Sylvan Lake trailhead just below Black Elk Peak. By 10 a.m., they numbered close to 80.

“The focal point of our gathering was to have family members of General Harney have an opportunity to apologize to members of the Little Thunder family,” said Basil Brave Heart, Oglala Lakota, an organizer of the event. Brave Heart initiated and led the effort to change the name of this highest peak east of the Rocky Mountains from Harney Peak to Black Elk Peak.

Among those standing in a circle that morning was Paul Stover Soderman, a seventh-generation descendant of General William Harney, known as The Butcher of Ash Hollow, and to the Lakota as the architect of the same conflict, known to them as the Massacre at Blue Water Creek. Soderman had come to apologize to Sicangu descendants of Chief Little Thunder, the Brule leader of those murdered in that conflict, and to seek forgiveness and healing.

Lies and Myths about Bisexual People.

I’ve gotten so weary over the years about the pervasive nonsense people hold in their heads about bisexuals, I gave up trying to talk sense about it. That was wrong, and I’ve been reminded that said nonsense still holds sway, and if things are ever going to get better for bisexual people, everyone has to get a good handle on the reality, and keep on speaking up. I’ve had a woman say to me “stay the hell away from my husband!…and me too!” and a man say to me “stay the hell away from my wife!” even though I’m very long time married , and happily so. I have no interest in someone else’s spouse because I’m not interested in cheating, it doesn’t have anything to do with  me being bi. It has more to do with me disliking any relationship in which a person will be hurt. After a while, such things didn’t even elicit an eyeroll, just a small sigh. Then I stopped talking about it, or mentioning it at all. Bisexual people still remain invisible, and often when we are visible, it’s simply to be scoffed at by someone or other. I think I can do better, and I think most other people can do better, too.

So here we are in the supposedly enlightened year of 2016, and yet, biphobia persists. In no particular order, here are a few of the most tiresome lies society really needs to stop telling about bisexual people.

1. Bisexuals don’t exist.
This is the first and most pervasive lie about bisexuality. Some people simply can’t fathom a sexuality in which individuals are attracted to more than one gender. You can test the waters, but you eventually must pick a side, the thinking goes. But bisexuals don’t need science — or the approval of those attracted to only one gender — to prove that they exist.

2. Bisexuals are just going through a phase.
Yes, it’s true that plenty of gays and lesbians used bisexuality as a way to soften the blow of coming out to conservative parents. Many may even have identified as bi for a time while they were still making sense of their own orientation. And while coming out is an intensely personal decision, the strategies of some should not invalidate the identities of the majority, for whom bisexuality wasn’t a “stepping stone” but the final, concrete destination.

Oil is hardly the only threat to Indigenous people. Along with oil billionaires, there are many other people who don’t need another dollar to see them through 10 lifetimes who seek to not only destroy Indigenous land, but the very life of those people. This is going on all over the world, not just in uStates and Canada. The rapacious desire for Coal, oil, gold, and more is threatening Indigenous populations everywhere. Corporations destroy everywhere they set their sights, with no thought past the bottom currency. The Tyonek have been waging a fight against coal for a very long time. You can start with this search page at ICTMN, just for some background. Almost every tribe in uStates who have depended on salmon for their main source of food, and have done so for thousands of years, have either lost that, or are fighting against that loss. Everywhere, it’s either coal, or a state damming rivers in order to steal water, leaving one tribe after another resourceless. There’s a very long article at the Grist about the current fight the Tyonek in Alaska are facing. I’m just to include a small bit here, click over to read the whole thing.

I want to take a moment, and point out a fine example of colonial thinking and implicit racism in the above. It must be pointed out that “oh, look – those Indians are using modern things, and eating modern stuff, but fighting for all that primitive traditional stuff!” If you happen to be a writer, and wish to cover indigenous issues, you might want to ask yourself why you think it’s ever so necessary to write something like that. You must be willing to confront your own colonial thinking and implicit biases. Yes, Indigenous people are a part of the world, just like everyone else. There’s more than a whiff of “eh, they could just assimilate if they really wanted to” there.

“What will we be left with?” he asks, his white mustache in contrast with his straight black hair. “The leftovers of their tailings, their coal dust? No salmon, no moose, no nothing.”

If approved, the Chuitna coal mine would be a leviathan. Standifer and the rest of the council painted the scene throughout the meeting: PacRim’s power shovels and dump trucks would trundle over the grasses, pulling down the shore pines and balsams, rolling them over the river’s watery bogs. The drills would dig into 14 miles of stream and send salmon fleeing one of two ways: upriver, back toward the spawning grounds where they were born, or downriver, toward the ocean where they spend their adult lives. One group will die, trapped upriver; the other will never make it back to reproduce.

Where the salmon once swam would sit an enormous coal mine, surrounded by an access road, a 10,000-foot elevated coal conveyor, an airstrip, a logistics center, and a brand new export terminal. The machines would burrow into the surface to reach a sparkling, black seam of ultra-low sulfur sub-bituminous coal — 300 million metric tons of it, to be exact. Layer by layer, the coal would tumble into trucks that would drive it to a conveyor belt to the sea. Some 500 workers in hard hats would gut the land like a salmon, and then float its innards 3,000 miles away to be burned in “countries in the Pacific Rim, Indonesia, India, and Chile,” according to PacRim’s website.

The first stage of the project is scheduled to last 25 years, but that wouldn’t be the end of it. The surrounding land, leased from the Alaska Mental Health Trust property, is expected to yield 1 billion metric tons of coal. PacRim owns a total of 20,571 acres of coal leases in the area — a swath that it could continue to mine decades into the future.

Tyonek is what’s known as a “closed tribe,” meaning outsiders cannot visit tribal property without signed consent from tribal leadership. But once a guest is invited onto the tribe’s land, that intimidating veneer slides right off. The residents are welcoming and friendly, though not overly eager to appease outsiders. The coastal village is pleasant and sleepy, with soft winds blowing down from the mountains, off the beach, and over the dusty roads. Members of the tribe meet at the tribal center, where women sit, share waffles, and chat about this year’s salmon run.

“Taking everything from the land is like taking the blood out of your vein,” says Janelle Baker, a member of the tribal council. She pulls up her sleeve and gestures to her wrist. “You can only take so much before it shuts down.”

PacRim has promised that the salmon run will be recreated decades from now, after the coal has been extracted. Mark Vinsel, executive administrator of the United Fishermen of Alaska, tells me that the project would “obliterate” the fishery, and that he is “not confident that it is possible” to restore the river after the damage is done.

In the near-pristine wild of Alaska, it’s not easy to dig something up and then put it back together, as Lance Trasky, a now-retired habitat biologist with the Alaska Department of Fish and Game, wrote in an email. “I am confident that the salmon habitat that would be mined in the proposed Chuitna coal lease area could not be restored to its former level of productivity after coal mining,” he says, adding that what PacRim is proposing has never been done before.

Time to Rethink Tampons.

Thankfully, I’m well past periods. I started very young (10 years old), but I was one of the fortunate people who had short duration, light periods most of my life. Even so, I was more than happy to see them go. Like many people, I used tampons, and I don’t like to think just how much I spent on them, either. Back in the day, the tubes were cardboard, not plastic, so at least that build up of waste isn’t on my shoulders. Tampons are handy, easily carried about and all that, but they do carry risks, and the plastic tubes are now a serious environmental problem. I never had the opportunity to use a menstrual cup, but if I were still dealing with periods, that’s definitely the way I’d go.

Cool Stuff Friday: MAD.

MAD (taken from the Danish word for “food”) is a not-for-profit organization that works to expand knowledge of food to make every meal a better meal; not just at restaurants, but every meal cooked and served. Good cooking and a healthy environment can and should go hand-in-hand, and the quest for a better meal can leave the world a better place than we found it. MAD is committed to producing and sharing this knowledge and to taking promising ideas from theory to practice.

MAD is a great place to lose yourself for ages on end. Food, food, food, but not all the regular ways food is addressed. Here, there is the breathtaking culture of food, from all over the world, the history of food, the art of food, traditions of food, innovations and artistry of food. Any curiosity you may have about food, you can find satisfaction at MAD. I’ve been trying to catch up, reading at the site for the past month or so, and I’ve barely made a dent. Two articles in particular got my attention in recent days: Turning Trash Into Delicious Things: a Brief Guide by Arielle Johnson, and A People’s History of Carolina Rice, by Michael Twitty.

The first article grabbed my attention because it addresses the waste of craft brewers, and that particular waste happens in my household, as Rick is a home brewer:

On an artisanal-industrial scale, spent grains—the malted barley that is steeped in water to make beer—is a major source of waste for craft brewers, with (roughly) 8 kilos of leftover barley for every 50 liters of finished beer. It can be used as animal fodder, but you can go beyond that, since it also presents creative flavor opportunities.

That waste, it turns out, can be used to make koji, which in turn can be used to make a form of miso. Click on over to the article for details, and recipes! The article on Carolina rice was eye-opening, and details the history of this rice from 3500 B.C.E. to 2013. There’s personal history in this overview of one food:

1770s: My great-great-great-great-great-great grandmother is captured in a war in Sierra Leone and brought to Charleston, without a doubt to grow and mill rice on a Lowcountry plantation. She is a member of the Mende people, who would later lead the Amistad slave ship revolt in 1839.

…Nothing much has changed for Indian Nations and their tribal members since Dee Brown’s book was written 46 years ago. Nothing – Until just recently! For some unexplainable reason, the book has miraculously come to life near a small Indian village in North Dakota, called Cannonball. In live and living color, just as the book revealed tragic treatment of Indian Nations in chapter after chapter, comes Tribal Nation after Tribal Nation announcing their arrival to the “Spirit Camp.” Here throngs of water and land protectors are gathering in a fight against corporate greed. Accounts of injustices and struggles in Indian country echoes throughout the camp and serves to strengthen the resolve to stop the Dakota Access Pipeline. “I want to cheer and cry I’m so happy to see the support that arrives daily and hourly,” said Chairman of Standing Rock Sioux Tribe, Dave Archambault II.

The words to describe the happening are hard to find. Never in the history of the America’s has so many Tribes come together is such a unified way. This joining is about expressing solidarity in behalf of Mother Earth and to also condemn the number one enemy of Mother Earth – Greed.

It is here beside the Cannonball and Missouri Rivers, that it appears the world is watching. It is here, that the Standing Rock Sioux have drawn the line against a history of crooked dealings and disrespect for all Native rights.

Standing Rock Testifies Before United Nations.

Standing Rock Sioux Chairman David Archambault II called on the United Nations on Tuesday to halt construction of the Dakota Access oil pipeline through tribal treaty territory and formally invited United Nations Special Rapporteur on the Rights of Indigenous Peoples Victoria Tauli-Corpuz to visit the reservation.

“I am here because oil companies are causing the deliberate destruction of our sacred places and burials,” he told the United Nations Human Rights Commission in Geneva on September 20. “Dakota Access wants to build an oil pipeline under the river that is the source of our nation’s drinking water. This pipeline threatens our communities, the river and the earth. Our nation is working to protect our waters and our sacred places for the benefit of our children not yet born.”

Speaking at the 33rd Session of the U.N. Human Rights Council, which runs from September 13 through 30, Archambault outlined the ways in which the pipeline and the treatment of water protectors by the company’s employees had violated the protectors’ human rights.

“Thousands have gathered peacefully in Standing Rock in solidarity against the pipeline,” he said in a statement from the tribe afterward. “And yet many water protectors have been threatened and even injured by the pipeline’s security officers. One child was bitten and injured by a guard dog. We stand in peace but have been met with violence.”
