But will he pay it?


Trump went to court again, to claim that he should not have to pay the large sum he was expected to pay to E. Jean Carroll for sexual assault. He lost.

A federal appeals court on Monday upheld a civil jury’s finding that President Donald Trump must pay $83.3 million to E. Jean Carroll for his repeated social media attacks and public statements against the longtime advice columnist after she accused him of sexual assault.

Does anyone believe he will ever pay that penalty, no matter how many courts and judges declare that he must? He’s just going to delay and delay and claim that no one is allowed to interfere with a US president, and wait out the judgement until he dies. That’s how the rich operate. If I had a legal claim of millions of dollars against me that I refused to pay, the sheriff would come to tow my car away, the city would start carving away my property, I’d be kicked out of my house and it would be auctioned off, and if I were really obstinate, I’d be hauled off to jail. But if you’re rich enough that you could pay the sum, they’ll respectfully watch you dither and scheme to get out of it.

One law for the wealthy, another law for the rest of us.

    To the best of knowledge (IANAL), there is an appeal bond. So if the case is finally ended, somebody will pay up, possibly whatever company backed the bond. (Then they, in turn, can try to get the money back from That Felon in the White House.)

    Just listened to Dan Savage interview her on Savage Love – she’s realistic about it but says she has a very aggressive lawyer and is confident she’ll get the money. And will then donate it all to good causes. She’s actually 2 years older than him; I have no idea what happens to the debt if she predeceases him.

    what @whheydt said above – he had to get a bond (+10%) from Federal Insurance Co (a division of Chubb) so I suspect the funds will be paid – (it isn’t that much money to him anymore with all the grift and crypto and bribes since he got re-elected and I would think the less he fights at this point the sooner this story goes away- but that line of reasoning would require, reasoning) so maybe he’s just get out of the way of the insurance company and allow the cash to move, and talk about war and vilify brown people and whatever else he thinks will distract the public from him being a creepy rapist and pedophile. I’m hopeful (but not optimistic) that the maga house of cards will soon come crashing down

    The judgement has already been rendered and now confirmed on appeal. Barring a reversal from a higher court (always a possibility) the money is technically now hers and became hers when the jury made their verdict. Thus it is part of her estate.

    I believe this means that if she predeceases Ronald Plump the money will be disbursed according to her will, supposing she has one, which I think to be virtually certain.

    Remember, the current president is a serial sexual abuser. During the process a lot of women turned up to testify about what the convicted fraudster and scammer had done to them.

    I suggest the court confiscates his gonads as collateral and keep them in a freezer until he has paid every cent owed.

    No, he is hoping it will be reversed on appeal. If it isn’t then even if they both die first his estate will owe it to here estate and his wife or kids will not see it. It will go to the Carroll estate, as it also will if she predeceases him.

    Possible results. Trump’s appeal is denied. Trump refuses to pay off. Jean Carroll’s lawyers move to confiscate Trump’s Bedminister golf course. Hilarity ensues.

    It is true that Trump fiddles the law like a player and Carroll is old but she has a better lawyer than he does. Her share will go to charity, directly or indirectly, eventually.

    This is a NY state case. Otherwise the SCOTUS would have quashed this case along with the other Federal prosecution for stealing classified materials.

    They can appeal to the NY Supreme Court, but I don’t know if they are required to hear another appeal.

    @ Tethys #14 — My understanding is that you may be conflating the two cases referred to in the press as Carroll I and Carroll II. Carroll I is over and done, and Trump’s appeal was denied. Carroll II was heard in federal court and is not a NY state case. BTW, the NY State Supreme Court is not the highest court in that state — the NY State Court of Appeals in the highest court.
