Enumeration of Constitutional Rights

There is an interesting discussion going on right now at Mike the Mad Biologist concerning the existence of a constitutional right to privacy. As usual, some deranged right-wing assmonkey has come out of the woodwork with usual lie about the enumeration of rights in the constitution:

The only way to get a right to abortion (control over one’s own reproductive faculty in general) into America’s costitution without dishonestly pretending that it says what you would like it to say is by amending it.

This represents a complete utter lie about the nature of the treatment of human rights in the Constititution. The United States Constitution is one of enumerated powers, but not one of enumerated rights.

The rights explicitly listed in the Bill of Rights and Constitution were expressly understood by EVERY-FUCKING-ONE at the time of ratification to have been EXEMPLARY and NON-FUCKING-EXCLUSIVE!!! The fear that stupid pernicious motherfuckers would misconstrue the enumeration of rights in a Bill of Rights as implying exclusivity was what led James Motherfucking Madison to initially argue passionately against including a Bill of Rights.

The fact that right-wing motherfucking fake-ass legal scholars ALWAYS ignore this proves that they are just lying sacks of shit making up anything they fucking want to justify their sick-fuck depraved dastardly policy goals. Read your motherfucking Federalist Papers, assknockers!

    You are wrong. Right wingers consistently promote their right to personally own whathefuckever firearm they like, jam it down their pants as a “concealed” weapon and swagger around in public like a modern day Hickock. Since that is not actually what the 2nd says, they are clearly down with the notion of un-enumerated rights. That, and the right to a capital-gains-tax cut, another sacred right. oh, and the ability to have your kids go to school only with their own “kind”. that’s a right. oh, and imposition of your wackaloon theocratic views on others? Pretty sure that’s one of those unenumerated rights too…

    Damn, all these unenumerated rights messin’ up my space and shit. I have the right not to have a ferret take a dump on my floor, but sadly this still happens.
    …So one of those rights they just forgot to include is the right to spray whipped cream all over the windshield of a parked car with one of those stupid bumper stickers that says shit like “My ex-wife’s other car is a broom”, right? I can totally do that, it’s a right, right? Right??

    I’m happy to see that someone beat me to saying both “read the fucking Federalist Papers” and “Read the fucking Ninth Amendment.” :)

    It’s depressing that I’ve been rereading the Federalist Papers over the last few months to remind myself that I’m not crazy for thinking/believing/remembering what I do about what the nation is supposed to be.

    What I find saddening about reading the Federalist Papers is not only seeing what is supposed to be, but seeing how exactly fucking right on every single motherfucking point they were about how things would FUCK UP in the absence of the constitutional structures they were arguing for. MOTHERFUCKING TYRANNY!
