Vexatious Litigant Sues Over Duck Dynasty

Move over, Larry Klayman and Orly Taitz. Chris Sevier, who apparently lives in Nashville but claims to go to the same church as the Duck Dynasty douchebag, has filed a lawsuit against the A&E network, GLAAD and President Obama over the suspension of the guy for bigoted comments.

This time around, Sevier put together a 91-paged complaint, quoting scriptures about the sins of homosexuality, saying “We live in a Christian nation ‘Jack.’” So how does this tie in to A&E and “Duck Dynasty”? Well, Sevier is claiming that A&E’s indefinite suspension of Phil Robertson is going to have a chilling effect on other churchgoers — himself included — when it comes to preaching what he believes is the word of God, reports TMZ.

Sevier also named President Obama in the suit, claiming Obama is in cahoots with A&E to “further a pro-gay agenda,” according to TMZ. The best part about this case is definitely the pictures Sevier included in his complaint. It’s unclear what legal purpose they serve, but they’re pretty dang amusing.

At the end of the day, Sevier’s claims will be tossed as a frivolous lawsuit because he states no cognizable legal claims. In addition, Robertson’s suspension doesn’t really impact him and he hasn’t suffered an actual injury from the suspension. For those reasons, Sevier has no standing to file a lawsuit against A&E.

Alas, when you quote scriptures in lieu of legal precedent, the court will almost certainly toss your lawsuit as frivolous. That’s what happened to one Oklahoma man who used Biblical references instead of statutes to make an argument in favor of polygamy.

This is the same guy who sued Apple, claiming that because his Macbook allowed him to access porn on the internet it turned him into an addict and ruined his marriage. And the same guy who was arrested for stalking a country singer a few months ago.

    A&E has now bowed to viewers pressure and reinstated Duck Dynasty and Papa Duck, so the suit will just be withdrawn or dropped. The network was hit from both sides by people who agree with the hatefilled speeches and people who don’t, but agree with his right to say them. And of course, by the bottom line.

    I’ve never heard any reports they were going to pull the whole show, just that Phil Robertson would be edited out. It’s too much of a moneymaker for them at the moment.

    A&E never announced canceling or suspending the show. A&E did suspend Phil Robertson for about two weeks, but even that never threatened the production of shows without Mr. Robertson appearing. That’s because the upcoming season’s shows were recorded prior to the publication of the GQ interview.

    Here’s a thought. Most people have already agreed that if somebody is politically incorrect nowadays, he/she stands to lose their job or their reputation or both. History has validated this to be truth many many times, especially in the past five years. It is further been agreed upon that popular opinion of our people pretty much dictate which way the wind blows with what is defined as something that is or is not politically correct.

    But then I take a look at what happened with the Chick-Fil-A situation a few months back and then I fast forward to recent times and look at the Duck Dynasty Phil Robertson scenario.

    The restaurant overwhelmingly survived the scare tactics that were thrown at them and the American people. As a matter of fact, they are doing far better since that idiotic game they were thrust into than any other time in their history. And A&E has reinstated Mr. Robertson. They of course did the right thing. And *** Barrel has restocked their shelves with Duck Dynasty memorabilia. They also did the right thing.

    So I am left with a puzzling thought regarding all this. My question I must pose is this:

    IF THE MINORITY HOMOSEXUAL COMMUNITY HAD AS MANY FOLLOWERS AND WERE AS LARGE A COMMUNITY THAT THEY WOULD HAVE US TO BELIEVE, THEN WHY DID CHICK-FIL-A DO SO WELL? WHY DID A&E REINSTATE MR. ROBERTON? WHY DID *** BARREL RESTOCK THEIR SHELVES WITH DUCK DYNASTY MEMORABILIA?

    Of course, fudging numbers is not something intelligent people have not be exposed to before. People do it all the time in an attempt to promote what they would have us believe.

    There is a gay man who is a retired lawyer and a liberal woman who do their best to counter the wild arguments there, but the conservatives rule the roost (it is a Texas paper) and they are insufferable lately.

    Sevier is apparently going to try to consolidate his Apple lawsuit with the Duck Dynasty because … well … because. Oh, and he is attempting to proceed “In Forma Pauperis” (as someone who cannot afford the filing fees).

    Opps, he is not presently a Tennessee attorney. He was placed on “Disability Inactive Status” in December 2011. According to some of his own paperwork in one of the five Federal District Court actions he filed in 2013, he claims that he suffers from PTSD from service in the Army.

    That’s quite a character. I would much rather see a reality show with him than with the duck guys.
