Another Appalling Search in New Mexico

Turns out that wasn’t the first time the police in New Mexico had ordered a body cavity search on someone they pulled with nothing even remotely like probable cause. They did it in another case where the only evidence was a drug dog “alerted” on the seat of a guy’s car.

4 On Your Side revealed how David Eckert rolled through a stop sign in Deming.

A K-9 named Leo alerted that it sniffed drugs on Eckert’s driver’s seat.

And, for the next 14 hours, those police officers, and doctors at the Gila Regional Medical Center performed eight medical procedures including x-rays, rectal finger exams, enemas, and finally a colonoscopy.

According to a federal lawsuit, officers Bobby Orosco and Robert Chavez were two of the officers involved, and they never found drugs inside Eckert…

Young is taken to the Gila Regional Medical Center in Silver City, and just like Eckert, he’s subjected to medical procedures including x-rays of his stomach and an anal exam.

Again, police found nothing, and again the procedures were done without consent, and in a county not covered by the search warrant.

We’ve learned more about that drug dog, Leo, that seems to get it wrong pretty often. He might be getting it wrong because he’s not even certified in New Mexico.

I don’t care if the dog was certified or not, study after study shows that drug dog “alerts” are wildly inaccurate, getting it right only a small percentage of the time. To use that as “evidence” to warrant what is essentially medical rape is barbaric and unjust. And every single person involved should be fired and prosecuted for torture.

    Here’s another one.
    Eckhart reputedly was stopped earlier, for a cracked windshield, and said or did something about “am I being detained?”. I don’t have the details, but that would explain this as likely revenge.

    You missed the part about the clenching.

    They only brought in the dog because Eckert was apparently standing with his legs together “clenching his buttocks.”

    Oh, and to be fair, you can’t blame the dogs for false alerts.

    The dog just wants to please his handler.

    LAS CRUCES – A Las Cruces woman has been charged $1,122 by a local hospital for a forcible body cavity search ordered by the Metro Narcotics Agency that did not turn up any illegal substances.

    She is now asking the county to pay her hospital bill.

    The woman, who is not being named because she was not arrested or criminally charged, was searched at Memorial Medical Center on July 1, according to a tort claim notice Las Cruces attorney Michael Lilley served to the county this week.

    Metro Narcotics Agency did finally pay the bill.

    It’s not enough to “end” the war on drugs. There need to be war crimes trials.

    Otherwise these kind of thugs will still be in law enforcement.
