Judge Reprimanded for Going Akin

A state judge in California has been publicly reprimanded by the state’s judicial oversight commission for saying the same thing Todd Akin said while presiding over a rape trial. And the judge was a former prosecutor in a sex crimes unit, for crying out loud.

The California Commission on Judicial Performance voted 10-0 to impose a public admonishment Thursday, saying Superior Court Judge Derek Johnson’s comments were inappropriate and a breach of judicial ethics.

“In the commission’s view, the judge’s remarks reflected outdated, biased and insensitive views about sexual assault victims who do not ‘put up a fight.’ Such comments cannot help but diminish public confidence and trust in the impartiality of the judiciary,” wrote Lawrence J. Simi, the commission’s chairman.

Johnson made the comments in the case of a man who threatened to mutilate the face and genitals of his ex-girlfriend with a heated screwdriver, beat her with a metal baton and made other violent threats before committing rape, forced oral copulation, and other crimes…

“I’m not a gynecologist, but I can tell you something: If someone doesn’t want to have sexual intercourse, the body shuts down. The body will not permit that to happen unless a lot of damage is inflicted, and we heard nothing about that in this case,” Johnson said.

A reprimand is not enough. This guy shouldn’t be anywhere near a bench.

    Is the judge claiming that not only can you not get pregnant, but you can’t even sexual intercourse if your body doesn’t want to? He needs a remedial 9th grade health course. And to not be a judge. Or anyone that makes decisions about anything ever.

    Sure, but he also qualifies as the latest Republican model for Congress. He’s already demonstrated he’s sufficiently misinformed to run a science- or health-related congressional committee.

    Not the same thing Akin said. Akin said that a woman’s body, if raped, will prevent itself from becoming pregnant. This jackass says that unless “a lot of damage is inflicted,” the woman wasn’t raped.

    In short, he doesn’t think a woman can deny consent to sex without getting the crap beaten out of her. In short, he doesn’t have a clue what “consent” means, nor does he likely care.

    Well it is fairly obvious that this ‘judge dredd’ picked up on the same bollix that has obviously been doing the rounds in repub/fundy circles.
    And just like the inevitable Chinese whisper syndrome what ‘dredd’ got was either a bastardized version, or he gave his version a bastardized slant himself to fit, but still acceptable to one of reduced cognizance and of a clear misogynistic bent.

    Right; I’m just pointing out that what this judge said was worse.

    And it’s been “doing the rounds” for a very long time. Both the notion that a woman can’t get pregnant from rape, and that it isn’t rape unless it involves assault and battery, are very old indeed.

    Not quite. As I read him, the judge isn’t talking about a beaten body, but a bruised vagina. He’s saying that women who don’t consent to sex will tear or have other injuries around the vulva when intercourse takes place — even if she lies perfectly still and doesn’t struggle at all. Presumably, fear makes her dry and tight. Always. And this causes damage. Always.

    Oh? I very much doubt this is true, but if this is what the judge was saying then maybe it’s not quite as outrageous as if he were complaining that all rape victims fight back or they weren’t raped. He’s wrong — but wrong in a different way.

    Well … at least the first four words are correct. Those following … not so much.

    I would love to see someone provide some evidence, scientific or other wise, to support that which follows. Where the hell do people get this stuff?

    And how can anyone with even a passing acquaintance with female anatomy and a functional knowledge of sex maintain such a belief?

    Two things; damn right your not, we can fucking see that. And second, since when did “beat[ing someone] with a metal baton [and making] violent threats before committing rape, forced oral copulation, and other crimes” not to mention the mental trauma of being threatened with “mutilat[ion of] the face and genitals… with a heated screwdriver” not count as “a lot of damage”? Is this guy a complete fucking idiot? How on Earth is he a Judge? Do you guys not demand qualificaions for that sort of thing? What the fuck?!
